1. Filing a Formal DMCA Notice of Infringement
To file a legally sufficient copyright infringement notification under 17 U.S.C. § 512(c)(3), please provide our Designated Copyright Agent with the following information via our Secure DMCA Takedown Portal:
- Physical or Electronic Signature: Your full legal name acting as an electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered, a representative list.
- Identification of Infringing Material: Clear identification of the material claimed to be infringing, including the exact URL(s) on Sopongo.com where the material is located.
- Contact Information: Valid contact information including full legal name, telephone number, and return email address for correspondence.
- Good-Faith Statement: A statement that you have a “good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (such as fair use).”
- Accuracy & Perjury Declaration: A statement that “the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
2. Designated DMCA Copyright Agent & Submission
To guarantee prompt logging and prevent automated notices from being trapped by email spam filters, all copyright notices must be submitted via our secure portal:
Takedown Form: Submit Formal DMCA Notice (Select Department: DMCA Takedown)
Department: Sopongo DMCA & Copyright Compliance Office
Response SLA: Verified notices are acknowledged within 24 to 48 business hours, and infringing material is promptly removed or disabled upon verification.
3. Image Removal & Fair Use Policy
Sopongo reviews consumer hardware and electronics. We utilize original hardware photography, official manufacturer press kit media, and licensed imagery under fair use editorial principles. If you are a copyright owner or authorized representative who desires the removal of any product photo, screenshot, or graphic, we honor immediate courtesy takedown requests. Please use our Contact Portal with the image URL and proof of ownership, and our team will remove or replace the asset promptly.
4. Counter-Notification Procedure
If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a formal counter-notification under 17 U.S.C. § 512(g)(3) through the same Contact Portal, including identification of the removed material, perjury declaration, and consent to federal jurisdiction.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Sopongo maintains a policy of terminating, in appropriate circumstances, access privileges for users or contributors who are deemed repeat copyright infringers.
